Terms of Service

These Terms of Service ("Terms") govern your access to and use of the applications and services provided by MiyaraHub Technologies LLC ("Company," "we," "our," or "us"), including but not limited to Elan Audio Lab, UC-Remote Integration Hub, Synology Manager, UPSight, FuryPath, and AVR Maestro (collectively, the "Software" or "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Use of Services
You may use our Services only in compliance with these Terms and all applicable laws. You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law
- Reverse engineer, decompile, or disassemble any part of the Services
- Attempt to gain unauthorized access to any part of the Services or related systems
- Interfere with or disrupt the integrity or performance of the Services
- Use automated systems (bots, scrapers) to access the Services without permission
- Reproduce, distribute, or create derivative works from the Services without authorization
2. Accounts
Some Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
3. Purchases & Payments
Certain Services may include the ability to purchase products, services, or app licenses. All payments are processed through third-party payment providers (Square, PayPal, Apple App Store, Google Play Store). By making a purchase, you agree to the payment provider's terms and conditions.

- We reserve the right to modify prices at any time
- Refund policies are detailed on individual product pages or upon request
- App purchases made through Apple App Store or Google Play Store are subject to those platforms' refund policies
4. Intellectual Property
All content, features, and functionality of the Services - including software, text, graphics, logos, and design - are owned by MiyaraHub Technologies LLC and are protected by copyright, trademark, and other intellectual property laws.
5. Third-Party Integrations
Our Services may interact with third-party hardware, software, and services (including but not limited to Unfolded Circle devices, Synology NAS systems, UPS devices from various manufacturers, HDFury HDMI processors, Denon/Marantz AV receivers, and various IoT devices). We are not responsible for the availability, functionality, or security of third-party products. Your use of third-party products is governed by their respective terms and conditions.
Changes to third-party hardware, firmware, APIs, or services may affect the functionality of our Software. We are not liable for any loss of functionality resulting from changes made by third-party manufacturers or service providers.
6. Local Network Access
Certain applications require access to devices on your local network (e.g., smart home controllers, NAS systems, UPS devices, cameras). By using these features, you acknowledge that:
- You have authorization to access and control the devices on your network
- Connection credentials are stored locally on your device
- We are not responsible for any misconfiguration or unauthorized access to your network devices
- Network device interactions (including but not limited to power management, container control, and device configuration) are performed at your own risk
7. Software Updates, Maintenance & Discontinuation
MiyaraHub Technologies LLC reserves the right to modify, update, suspend, or discontinue the Software (or any part thereof) at any time, with or without notice. The Company is not obligated to provide maintenance, support, updates, or patches for any Software indefinitely.
Software updates, when provided, are at the sole discretion of the Company. There is no guarantee of continued development, feature additions, bug fixes, or compatibility updates. The Company shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Software.
If a paid application is discontinued, users who have already purchased the Software retain their existing license but are not entitled to future updates, refunds, or continued support beyond the discontinuation date.
8. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. In such cases, implied warranties are limited to the minimum period required by applicable law.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MIYARAHUB TECHNOLOGIES LLC'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE OR SERVICE GIVING RISE TO THE CLAIM, OR FIFTY US DOLLARS ($50.00), WHICHEVER IS GREATER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIYARAHUB TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your access to or use of (or inability to access or use) the Services
- Any conduct or content of any third party on the Services
- Unauthorized access, use, or alteration of your data
- Interaction with hardware devices on your network through our applications
- Power outages, equipment damage, or data loss related to UPS monitoring or management
- Third-party hardware or firmware changes that affect Software functionality
10. Indemnification
You agree to indemnify and hold harmless MiyaraHub Technologies LLC from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.
11. Termination
We may terminate or suspend your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately.
12. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts located in Collin County, Texas.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated date. Your continued use of the Services after changes constitutes acceptance.
14. Open Source
Some of our projects may include open-source components. These components are subject to their respective open-source licenses, which take precedence over these Terms where applicable.
